Article 50 of the AI Act has applied directly in Spain since 2 August 2026. The national implementing law has been before parliament as a bill since 12 June 2026 (BOCG A-97-1).
Under the bill, the supervisory agency AESIA would be responsible. A deployer's failure to label deep fakes would be a serious infringement, with fines up to EUR 7.5 million or 1 % of worldwide turnover; SMEs face the lower amount.

The bill does not create a new labelling duty. It decides who enforces Article 50 and how breaches are classified.
What the bill says for retailers
- Authority. The Spanish AI Supervisory Agency (AESIA) would supervise AI systems subject to Article 50 transparency duties.
- Classification. A deployer who fails to disclose deep fakes under Article 50(4) and (5) commits a serious infringement (Article 21(1)(b)).
- Amount. Up to EUR 7.5 million or up to 1 % of worldwide turnover in the previous year, whichever is higher (Article 30(1)(c)). For SMEs, including start-ups, the lower amount applies (Article 30(8)). The preliminary draft of 11 March 2025 still set EUR 500,000 to 7.5 million or 1 to 2 % of turnover; the minimum amounts are gone.
- Assessment. Nature and duration of the breach, company size, cooperation with the authority and measures taken all count (Article 31).
What this means for retailers
Label for Spanish customers now, under Article 50. Spanish text next to "AI" helps understanding, for example "Generada con IA". No wording is prescribed for retailers.
