Not legal advice. ## Key facts (EN) - Since 2 August 2026, deployers of an AI system must disclose that image, video or audio content constituting a deep fake has been artificially generated or manipulated (Article 50(4) of the EU AI Act, Regulation (EU) 2024/1689). There is no transition period for deployers. - A deep fake is AI-generated or manipulated image, audio or video content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful (Article 3(60)). According to the European Commission's guidelines this includes consumer goods, and it is enough that something could plausibly exist (C(2026) 5054, para. 113). - An online retailer is a deployer when it, or a contractor acting on its instructions, uses AI to create or change images (guidelines paras. 12, 14). A retailer that merely passes on third-party images is generally not. - The disclosure must be clear and distinguishable, given at the latest at the time of first exposure and accessible (Article 50(5)). A notice only in terms and conditions, menus or an information page is not enough (guidelines para. 142). - The Code of Practice on Transparency of AI-Generated Content (final version of 10 June 2026) uses the acronym “AI” as the main visual element, visible without interaction, in a place free of overlapping elements, for example the top right corner. - The European Commission provides three freely usable icons: “AI”, “AI GENERATED” and “AI MODIFIED”, each in black and white. Using them is optional; labelling is not. - Standard editing such as colour correction, background removal or cropping, and a purely decorative AI background behind a real, unchanged product, generally do not turn an image into a deep fake under the guidelines (paras. 92, 116). - Deep fakes generated or manipulated before 2 August 2026 do not need to be labelled retroactively, although the guidelines encourage it (para. 154). - Providers of generative AI systems must mark their output in a machine-readable format (Article 50(2)). For systems placed on the market before 2 August 2026 this applies from 2 December 2026 (Article 111(4) as amended by Regulation (EU) 2026/1744). - Infringements of Article 50 can be fined up to EUR 15 million or 3 % of worldwide annual turnover, whichever is higher; for SMEs the lower amount applies (Article 99(4) and (6)). In Germany the Federal Network Agency (Bundesnetzagentur) is the market surveillance authority. ## Kernfakten (DE) - Seit dem 2. August 2026 müssen Betreiber eines KI-Systems offenlegen, dass Bilder, Videos oder Audioinhalte, die ein Deepfake sind, künstlich erzeugt oder manipuliert wurden (Art. 50 Abs. 4 KI-Verordnung, VO (EU) 2024/1689). Für Betreiber gibt es keine Übergangsfrist. - Ein Deepfake ist ein mit KI erzeugter oder manipulierter Bild-, Ton- oder Videoinhalt, der wirklichen Personen, Gegenständen, Orten, Einrichtungen oder Ereignissen ähnelt und fälschlich echt erscheinen würde (Art. 3 Nr. 60 KI-VO). Nach den Leitlinien der EU-Kommission zählen auch Konsumgüter dazu, und es genügt, dass etwas plausibel existieren könnte (C(2026) 5054, Rn. 113). - Ein Onlinehändler ist Betreiber, wenn er selbst oder ein Dienstleister nach seinen Vorgaben KI einsetzt, um Bilder zu erzeugen oder zu verändern (Leitlinien Rn. 12, 14). Wer fremde Bilder nur weitergibt, ist es nach den Leitlinien in der Regel nicht. - Die Kennzeichnung muss klar und unterscheidbar sein, spätestens bei der ersten Aussetzung erfolgen und barrierefrei sein (Art. 50 Abs. 5 KI-VO). Ein Hinweis nur in AGB, Menüs oder auf einer Infoseite reicht nicht (Leitlinien Rn. 142). - Der Code of Practice zur Transparenz KI-generierter Inhalte (finale Fassung vom 10.06.2026) sieht das Akronym „AI“ als Hauptelement vor, sichtbar ohne Interaktion, an einer Stelle ohne überlagernde Elemente, zum Beispiel oben rechts. - Die EU-Kommission stellt drei frei nutzbare Icons bereit: „AI“, „AI GENERATED“ und „AI MODIFIED“, jeweils in Schwarz und Weiß. Die Nutzung ist freiwillig, die Kennzeichnung selbst nicht. - Standardbearbeitung wie Farbkorrektur, Freistellen oder Zuschnitt sowie ein rein dekorativer KI-Hintergrund hinter einem echten, unveränderten Produkt machen ein Bild nach den Leitlinien in der Regel nicht zum Deepfake (Rn. 92, 116). - Deepfakes, die vor dem 2. August 2026 erzeugt oder verändert wurden, müssen nicht nachträglich gekennzeichnet werden; die Leitlinien ermutigen aber dazu (Rn. 154). - Anbieter generativer KI-Systeme müssen deren Ausgaben maschinenlesbar markieren (Art. 50 Abs. 2). Für Systeme, die vor dem 2. August 2026 in Verkehr gebracht wurden, gilt das ab dem 2. Dezember 2026 (Art. 111 Abs. 4 in der Fassung der VO (EU) 2026/1744). - In Deutschland ist die Bundesnetzagentur zuständig (KI-MIG, in Kraft seit 29.07.2026). Verstöße gegen Art. 50 können mit bis zu 15 Mio.
